Losing exp on death level 62

I did try looking this up first to see if it had changed but i am losing exp at level 62 when i die.

I thought this starts at 70?

Can anyone help explain?

It depends upon the level of the area you are in, not your character level.

If you are in a map / endgame area of level 65+ and die you will incur a death penalty of 10% experience. The final area of Act 6 (Black Chambers) is level 64.

Pinnacle boss encounters are now exempt from the penalty and there are a few mechanisms to mitigate the loss.
