A PoE mousepad is cool, but GGG should get the business from it at some point if they want it. " The problem here is that instead of simply asking and knowing for sure, you are making assumptions. Assumptions not only that it's ok to use their assets for other than they've already allowed, but that you can freely use their assets to advertise as you see fit on their behalf. You assume that your advertising is nondestructive. You assume rights that aren't yours. " I'm not a lawyer, but I'm pretty sure that copyright is lost if a company fails to enforce it. That is, they set precedent by indirectly allowing use of once copyrighted material over a period of time. What's the difference between you ordering a PoE mousepad from their store, or you ordering a generic mousepad from their store with a PoE image on it? Certainly a larger scale of copyright violation if the site hosts the image in the store than if they allow the creation of one unit, but both, I think, clear violations (the latter by the customer as well as the site). Just think of how much revenue/support GGG would lose if any company could freely market their assets for potentially lower costs than GGG can at some point? It wouldn't stop at mouse pads, I guarantee it. Shirts, hats, (travel) mugs, key tags, laser pointers, laptop/phone/tablet skins, ..... there are thousands of imprintable promotional items. That's a huge amount of potential income for GGG that they need to protect. But GGG can, if they choose, give you permission to have another company create a single PoE mousepad for you without setting precedent and having to allow others to do the same. That's their choice. Seems like a lot of "sillyness," perhaps, given that you want to have just one mousepad made.. but it all comes back to one simple question. Why not just ask GGG if it's ok? |
